This Privacy Policy (the "Policy") describes the manner in which SSM Junk Removal ("SSM Junk Removal", "we", "us" or "our") collects, uses, discloses, retains and safeguards personal information in the course of its commercial activities, including the operation of the website located at ssmjunkremoval.com (the "Site") and the provision of junk removal, hauling and cleanout services (the "Services").

We handle personal information in accordance with the Personal Information Protection and Electronic Documents Act, S.C. 2000, c. 5 ("PIPEDA") and the ten fair information principles set out in Schedule 1 thereto, and, where applicable, Canada's Anti-Spam Legislation, S.C. 2010, c. 23 ("CASL"). By submitting a quote request, contacting us, or otherwise using the Site, you consent to the practices described in this Policy.

1.Accountability

1.1SSM Junk Removal is accountable for personal information under its control. The owner of the business acts as the individual designated to oversee compliance with this Policy and may be reached using the contact particulars in Section 11.

1.2Where personal information is transferred to a third party for processing, we require by contract or other means that a comparable level of protection be maintained while the information is being processed by that party.

2.Identifying Purposes

2.1We identify the purposes for which personal information is collected at or before the time of collection. Those purposes are: (a) to prepare, deliver and follow up on estimates and quotations; (b) to schedule, dispatch, perform and invoice the Services; (c) to communicate with you about your job, including by telephone, text message and email; (d) to maintain business records, including for accounting, insurance and tax purposes; (e) to investigate and respond to complaints, claims, damage reports and disputes; (f) to comply with legal, regulatory, municipal and waste-diversion reporting obligations; and (g) to measure and improve the performance of the Site.

2.2We will not use personal information for a new purpose materially different from those set out in Section 2.1 without first obtaining your consent, except where such use is permitted or required by law.

3.Consent

3.1Your knowledge and consent are required for the collection, use or disclosure of personal information, except where inappropriate or where an exception under sections 7(1), 7(2) or 7(3) of PIPEDA applies. Consent may be express or, in respect of non-sensitive information collected for an obvious purpose, implied by your act of submitting a request for Services.

3.2You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice. Withdrawal of consent may prevent us from providing all or part of the Services. To withdraw consent, contact us as set out in Section 11.

3.3Where we send you a commercial electronic message, we will identify the sender, provide contact information and include a functioning unsubscribe mechanism in accordance with CASL.

4.Limiting Collection

4.1We collect only such personal information as is necessary for the purposes identified in Section 2.1, by fair and lawful means. This ordinarily consists of: your name; telephone number; email address; the service address and municipality where work is to be performed; a description of the items, materials or volume to be removed; requested timing; access details relevant to the job; photographs you elect to send us; and any further particulars you volunteer in a message.

4.2We do not knowingly collect personal information from individuals under the age of majority in the Province of Ontario, and we do not request sensitive categories of information such as government identifiers or financial account credentials through the Site.

4.3The Site may automatically record technical information such as IP address, browser type, device characteristics, referring URL and pages viewed, whether directly or through analytics providers acting on our behalf. Where such information is linked to an identifiable individual it is treated as personal information under this Policy.

5.Limiting Use, Disclosure and Retention

5.1Personal information is not used or disclosed for purposes other than those for which it was collected, except with your consent or as required or permitted by law.

5.2We do not sell, rent, trade or licence personal information. We may disclose personal information to: (a) employees, crew members and subcontractors who require it to perform the Services; (b) service providers that host our website, deliver our email notifications, or provide analytics, on terms limiting their use of the information to the provision of those services; (c) licensed transfer stations, recyclers, charities and disposal facilities, to the limited extent necessary to lawfully dispose of or divert materials; (d) our insurers, accountants and legal advisors; and (e) law enforcement, regulators or a court of competent jurisdiction where compelled or permitted by applicable law.

5.3Personal information is retained only as long as necessary to fulfil the identified purposes and to satisfy applicable limitation periods and record-keeping obligations, after which it is destroyed, erased or de-identified. Quotation and job records are ordinarily retained for a period of up to seven (7) years consistent with Canadian tax and limitation requirements.

5.4Personal information may be stored or processed on servers located outside of Canada, in which case it may be subject to lawful access requests by foreign courts, law enforcement and national security authorities of the jurisdiction in which it is held.

6.Accuracy

We take reasonable steps to ensure that personal information is as accurate, complete and up to date as is necessary for the purposes for which it is to be used. You are responsible for informing us of changes to your contact or service information.

7.Safeguards

7.1We protect personal information by security safeguards appropriate to its sensitivity, including transmission of website form data over encrypted connections, access controls limiting internal access to those with a need to know, and administrative measures governing the handling and disposal of records.

7.2No method of transmission or storage is absolutely secure. Except to the extent liability cannot lawfully be excluded, we do not warrant that personal information will remain free from unauthorized access, and you acknowledge that you transmit information to us at your own risk.

8.Cookies and Analytics

The Site may use cookies, local storage and similar technologies to maintain session state, remember preferences and compile aggregate statistics about Site usage. Most browsers allow you to refuse or delete cookies through their settings; disabling cookies may impair certain features of the Site. Aggregated or de-identified statistical information that cannot reasonably be associated with an identifiable individual is not personal information and may be used without restriction.

9.Openness and Individual Access

9.1Upon written request, we will inform you of the existence, use and disclosure of your personal information and give you access to that information, subject to the exceptions in section 9 of PIPEDA, including where disclosure would reveal personal information about a third party or is protected by solicitor-client privilege.

9.2We will respond to an access request within thirty (30) days of receipt or such longer period as PIPEDA permits, and will advise you if a fee applies before processing the request. Where information is demonstrated to be inaccurate or incomplete, we will amend it as required.

10.Challenging Compliance

You may challenge our compliance with this Policy by contacting us as set out in Section 11. We will record, investigate and respond to all complaints. If your complaint is not resolved to your satisfaction, you may refer the matter to the Office of the Privacy Commissioner of Canada.

11.Contact and Amendment

11.1Inquiries, access requests, consent withdrawals and complaints may be directed to SSM Junk Removal by telephone or text message at (249) 889-9769, or through the quote and contact forms available on the Site.

11.2We may amend this Policy from time to time. The amended Policy takes effect on publication to the Site, and the "Last updated" date above will be revised accordingly. Material amendments affecting the purposes of collection will not be applied to previously collected information without consent where consent is required.

11.3This Policy is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
