1.Informational Purpose Only

1.1The content of the Site, including service descriptions, pricing guidance, cost ranges, preparation checklists, articles and references to municipal or provincial waste requirements, is published for general informational purposes only. It does not constitute legal, environmental, engineering, structural, insurance, tax or other professional advice, and it must not be relied upon as a substitute for advice from a qualified professional retained in respect of your particular circumstances.

1.2No advisory, fiduciary or contractual relationship is created by your use of the Site or by your submission of a quote request. A contract for services arises only as described in the Terms of Use and Service.

2.Accuracy and Currency of Content

2.1While we take reasonable care to publish accurate information, we make no representation, warranty or condition, express or implied, as to the accuracy, completeness, reliability, suitability or currency of any content on the Site.

2.2Landfill, transfer station and recycling depot hours, accepted material lists, tipping rates, diversion programs and municipal by-law requirements are set by third parties and change without notice. You should verify such matters directly with the City of Sault Ste. Marie, the applicable township or the operator of the facility in question before relying on them.

2.3Content may be amended, supplemented or withdrawn at any time without notice, and we are under no obligation to update information that has become outdated.

3.Estimates, Pricing and Volume Illustrations

3.1Any price, price range, minimum charge, load fraction or "starting at" figure appearing on the Site is an illustration only. It is not an offer, quotation or guarantee of the price applicable to your job.

3.2Actual pricing is determined at the job site by reference to the volume and weight of material, material type, labour and time required, number of crew, access and carry distance, stairs, disposal and tipping fees, and travel distance. Estimates given remotely, including from photographs or descriptions, are necessarily provisional and subject to confirmation on inspection.

3.3Photographs, illustrations and truck-capacity graphics used on the Site are representative and may not depict the specific vehicle, equipment or crew assigned to your job.

4.Service Availability

4.1Reference on the Site to a community, township or First Nation within our service area indicates that we may be available to serve that area; it is not a warranty of availability on any particular date or at any particular price. Availability outside the City of Sault Ste. Marie varies with travel distance, job size, road and seasonal conditions and routing.

4.2Statements respecting same-day, next-day or emergency service describe capability, not entitlement. All appointment windows remain subject to scheduling, weather, equipment availability and the operating hours of disposal facilities.

5.Regulated, Hazardous and Prohibited Materials

5.1We are not a licensed hazardous waste carrier or abatement contractor. Materials including asbestos and asbestos-containing materials, lead- and mercury-bearing waste, PCBs, fuels, solvents, paints, oils, propane and pressurized cylinders, ammunition and explosives, radioactive material, biomedical or pathological waste, animal or human remains and contaminated soil require a suitably licensed contractor and lawful handling under the Environmental Protection Act, R.S.O. 1990, c. E.19 and the regulations thereunder.

5.2Guidance on the Site concerning what may or may not be accepted is general and does not relieve you of your obligation to identify materials accurately. We reserve the right to decline any material in our sole discretion. Nothing on the Site should be construed as confirmation that a particular material is lawful to dispose of in a given manner.

6.Diversion, Donation and Recycling Statements

Where the Site refers to recycling, donation, salvage or diversion from landfill, such statements describe our general practice and intention. They are not a guarantee that any particular item will be donated, recycled, resold or diverted, as outcomes depend on the condition of the item and on the acceptance criteria of independent charities, recyclers and processors. Title to items collected passes to us on loading, and their disposition is at our discretion.

7.Testimonials, Reviews and Results

Any testimonial, review or description of past work reflects the experience of the individual concerned in the circumstances of their job and is not a representation that you will obtain comparable results, timing or pricing. Testimonials are not compensated unless expressly disclosed.

8.Third-Party Links and External Content

The Site may contain links or references to third-party websites, facilities, charities or resources provided for convenience only. We do not control, endorse, sponsor or assume responsibility for the content, policies, practices, availability or accuracy of any third-party resource, and your dealings with any third party are solely between you and that party.

9.No Warranty as to the Site

The Site is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, conditions and representations, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that the Site will be uninterrupted, secure, error-free or free of viruses or other harmful components.

10.Limitation of Liability

10.1To the maximum extent permitted by law, SSM Junk Removal and its owners, employees, contractors and agents shall not be liable for any direct, indirect, incidental, consequential, special, exemplary or punitive loss or damage, or for any loss of profit, revenue, business, data or anticipated savings, arising out of or in connection with your access to, use of, or reliance upon the Site or any content on it, whether founded in contract, tort (including negligence), breach of statutory duty or otherwise.

10.2Nothing in this Disclaimer excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited, nor does it limit any non-waivable right you may have under the Consumer Protection Act, 2002, S.O. 2002, c. 30, Sch. A.

11.Severability, Governing Law and Contact

11.1If any provision of this Disclaimer is found to be invalid or unenforceable, that provision is severed and the remainder continues in full force and effect.

11.2This Disclaimer is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, and the parties attorn to the exclusive jurisdiction of the courts of Ontario sitting in the District of Algoma.
